Definitions

“Customer” means a customer who has been issued with a GIFTMORE DOLLAR CARD by the Promoter pursuant to the Program and is the specified holder of the GIFTMORE DOLLAR CARD.

“GIFTMORE DOLLAR CARD” means the smart chipped card device issued to the Customer containing the relevant number of gift dollars ranging in value from $100.00 to $1,000.00.

“Gift Dollars” means the nominated value which is pre-loaded on to the GIFTMORE DOLLAR CARD at the time of issue. Each Gift Dollar has a value of $1.00. There is a minimum of one hundred ($100.00) Gift dollars and a maximum of one thousand ($1,000.00) Gift dollars which may be pre-loaded on any GIFTMORE DOLLAR CARD. Where more than $1,000.00 is required, additional cards must be purchased. The number of Gift dollars pre-loaded on each GIFTMORE DOLLAR CARD issued is specified on the reverse of the card.

Terms

“Program” means the Rendezvous GIFTMORE DOLLAR CARD Program, as governed in accordance with these Terms and Conditions;

“Promoter” Rendezvous Hotels & Resorts (ABN 65 081 207 838) of: Level 8, 36 Carrington Street, Sydney, NSW, 2000.

“Program Accommodation and Food & Beverage” means hotel accommodation and meals and/or bar expenses (if applicable) provided by Participating Hotels in the Program which Customers may redeem using their Gift dollars.

“Participating Hotels” means those hotels listed at www.rendezvoushotels.com as participating hotels for the Program.

“Purchaser” means a customer that orders and purchases a GIFTMORE DOLLAR CARD from the Promoter pursuant to the Program.

Use of GIFTMORE DOLLAR CARD at Participating Hotels

1. The Customer may make their hotel reservation at a Participating Hotel by directly calling the hotel reservations department. The Participating Hotel will require a credit card number as a guarantee to confirm and hold the accommodation. At the time of check-in the Purchaser then presents the original GIFTMORE DOLLAR CARD if he/she wishes to redeem the Gift Dollars in exchange for Program Accommodation and Food & Beverage. At check-out the credit card advice will be destroyed if the Purchaser redeems the final account utilising their GIFTMORE DOLLAR CARD.

2. Copies of GIFTMORE DOLLAR CARD’s will not be accepted. GIFTMORE DOLLAR CARD’s will be deemed void if altered in any way. The Participating Hotel may refuse a damaged GIFTMORE DOLLAR CARD or any GIFTMORE DOLLAR CARD it reasonably suspects has been altered, stolen or is not valid.

3. GIFTMORE DOLLAR CARD’s, Gift Dollars, or Program Accommodation and Food & Beverage bought with them, are not redeemable for cash or credit card transactions, hotel credit line or hotel accounts.

If there are sufficient Gift Dollars on the Customer’s GIFTMORE DOLLAR CARD to redeem the selected Program Accommodation and Food & Beverage in full, the GIFTMORE DOLLAR CARD dollars cannot be used in conjunction with part-cash payments. If there are insufficient Gift Dollars on the Customer’s GIFTMORE DOLLAR CARD’s to redeem the selected Program Accommodation and Food & Beverage in full, then the balance may be purchased by the Customer with a cash or credit card payment.

4. Participating Hotels may change from time to time (as determined by the Promoter in its discretion) and an up-to-date list may be obtained from the GIFTMORE DOLLAR CARD area on the Rendezvous Hotels & Resorts website located at www.rendezvoushotels.com. All Participating Hotels listed are correct at the time of the printing, and it is the sole responsibility of the Customer to check whether a particular hotel is a Participating Hotel, prior to making the reservation.

5. GIFTMORE Dollars can be used to redeem Program Accommodation and Food & Beverage, meals, bar tabs, room service and other services as available at participating hotels. Any other travel costs and expenses incurred are the sole responsibility of the Customer.

6. A GIFTMORE DOLLAR CARD may not be “topped up” with additional Gift Dollars to those already pre-loaded onto the GIFTMORE DOLLAR CARD at the point of issue. Any additional Gift Dollars will require the purchase of a new GIFTMORE DOLLAR CARD and Gift Dollars, in accordance with these Terms and Conditions. The Customer may, however, redeem Gift Dollars, in exchange for Program Accommodation and Food & Beverage using two or more separate GIFTMORE DOLLAR CARD’s at the same time.

7. Reservations at Participating Hotels are subject to availability at the time of making the reservation. Accommodation Reservations should be made as far in advance as possible as heavy demand may apply to seasonal periods, including school holidays and public holidays and/or any special events periods. No guarantee can be given that a particular room will be available at any Participating Hotel, or for the days that the individual Customer may prefer.

8. If a Customer wishes to cancel his/her reservation, he/she must do so by contacting the hotel directly and advising them of the relevant cancellation (“Cancellation Notice”). If the Customer fails to give the Cancellation Notice by 6pm on the day before the scheduled date of arrival at the relevant Participating Hotel pursuant to the reservation, the Promoter, or the relevant Participating Hotel will be entitled to deduct the requisite number of Gift Dollars in relation to one night’s accommodation as a cancellation fee. If there are not enough Gift Dollars on the Customer’s GIFTMORE DOLLAR CARD to cover the applicable fee, then the relevant Participating Hotel may charge the Customer’s credit card for the balance of the amount owing.

Purchase, Payment and Delivery of GIFTMORE DOLLAR CARD’s

9. Purchase of a GIFTMORE DOLLAR CARD can be ordered online at www.rendezvoushotels.com/giftmore or by calling Central Reservations on 1300 661 771. Orders made online must be purchased using a credit card. Orders made via Cental Reservation must be purchased by cheque or credit card.

10. Orders for purchasing GIFTMORE DOLLAR CARD’s will only be dispatched when full payment (of the amount equating to the number of Gift Dollars pre-loaded on the card, in each case) is received by the Promoter (including any service or postage charges) in accordance with these Terms and Conditions. Refunds and exchanges are not available after full payment is received.

11. Orders will be dispatched within 10 business days of receipt of the order and payment in full. Valid orders and payment in full must be received by 10.00am if the day of receipt of the order is to be included in the 10 business day period. If payment is made by way of cheque, an additional 5 business days must be allowed prior to dispatch of an order. Accepted credit cards include: American Express, Diners Club, Visa and MasterCard. 12. GST: Australia; all stated prices are inclusive of GST unless otherwise stated. Any other taxes, charges, fees or duties that are, or may be levied on such prices or Program Accommodation and Food & Beverage must be paid for by the Purchaser unless otherwise stated.

13. Postage and courier charges may apply as follows: A charge of $7.50 per order will apply and is payable at the same time as payment is made and submitted with an order for purchasing a GIFTMORE DOLLAR CARD. Up to 5 GIFTMORE DOLLAR CARD may be sent per order. This charge is subject to change. For larger quantities, please contact the GIFTMORE DOLLAR CARD Co-ordinator to determine the postage or courier charges.

14. The Promoter is not responsible for any incorrect or inaccurate information submitted during the ordering process, either caused by the Purchaser and/or Customer or by any of the equipment or programming associated with or utilised in this Program, or by any technical error that may occur in the course of the administration of this. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of orders and/or other information submitted in connection with this Program.

Delivery

15. GIFTMORE DOLLAR CARD’s will be delivered by post or can be purchased at participating hotels from the front desk reception. The Promoter and any Participating Hotel will not be held liable for any loss as a result of a GIFTMORE DOLLAR CARD being lost, stolen or damaged once dispatched for delivery by the Promoter.

16. The Purchaser is responsible for informing the Promoter of the correct contact name(s) and address(es) for ensuring correct delivery of the GIFTMORE DOLLAR CARD(s). Changes to orders must be made in writing and forwarded by mail, email or facsimile to the GIFTMORE DOLLAR CARD Co-ordinator. Changes made via telephone will not be accepted. Changes to orders will only be possible prior to an order being processed by the GIFTMORE DOLLAR CARD Co-ordinator.

Expiry Date of Cards

17. All GIFTMORE DOLLAR CARD’s will be valid for 12 months from the date of issue (“Validity Period”).

18. If the Customer is not able to fully redeem all of the Gift Dollars on a GIFTMORE DOLLAR CARD for Program Accommodation and Food & Beverage within the Validity Period, she/he may apply for an extension of the Validity Period by making such application in writing to the Promoter by no later than 1 month prior to the expiration of the Validity Period.

To apply for an extension, Customers must clearly specify in writing the following information:

(i) the reason why an extension to the GIFTMORE DOLLAR CARD is being requested,
(ii) the identification number of the GIFTMORE DOLLAR CARD, and
(iii) the expiry date of the GIFTMORE DOLLAR CARD.

And either post the written application to GIFTMORE DOLLAR CARD Co-ordinator at Rendezvous Hotels & Resorts, or by email to: giftmore@rend.com.au

The Promoter may grant the Customer an extension of the Validity Period at its absolute discretion but is not bound to do.

19. If an extension to the Validity Period is granted by the Promoter, the Customer must return the GIFTMORE DOLLAR CARD to the GIFTMORE DOLLAR CARD Co-ordinator along with an administration fee of $50.00 per GIFTMORE DOLLAR CARD. The GIFTMORE DOLLAR CARD Co-ordinator will then arrange for a new GIFTMORE DOLLAR CARD/s to be issued in replacement of the old one (with the balance of the Gift Dollars on the old GIFTMORE DOLLAR CARD transferred to the new GIFTMORE DOLLAR CARD) and the extended Validity Period will be recorded on the new GIFTMORE DOLLAR CARD.

Lost/Stolen Cards

20. The Customer is not entitled to a cash refund of any unused Gift Dollars on a lost, stolen, forged, damaged, or tampered GIFTMORE DOLLAR CARD.

21. The Promoter does not accept any responsibility for lost, stolen or damaged GIFTMORE DOLLAR CARD’s or for the un-authorised use of any GIFTMORE DOLLAR CARD.

Liability

22. To the extent permitted by law, the liability of the Promoter and any Participating Hotels, to any Purchaser and Customer, in relation to the conduct and administration of the Program, is limited to the cost of the re-supply of a GIFTMORE DOLLAR CARD (with the relevant number of Gift Dollars originally purchased, save that where the Promoter determines that one or more Gift Dollars has already been redeemed by the Customer, it will award the balance of the Gift Dollars, as determined by the Promoter in its discretion, with the replacement GIFTMORE DOLLAR CARD).

Dispute

23. In the event of any problem or dispute arising in relation to the GIFTMORE DOLLAR CARD, or any Program Accommodation and Food & Beverage purchased with the GIFTMORE DOLLAR CARD, or any other dispute in relation to any matter concerning the conduct or administration of the Program, the Promoter may authorise the GIFTMORE DOLLAR CARD Co-ordinator to consult with the Customer or Purchaser (as the case may be) in order to resolve the dispute, but this does not create an obligation on the Promoter to do so.

24. Any and all decisions of the Promoter in relation to any aspect of this Program will be final and binding on the Customer and Purchaser.

Acceptance of Terms

25. The submission of an order will be deemed to constitute acceptance of these Terms and Conditions.

Right to Change, Modify and Amend

26. These Terms and Conditions are subject to the specific terms and conditions of each Participating Hotel and all applicable laws in the country where the GIFTMORE DOLLAR CARD is purchased.

27. The Promoter reserves the right to modify, change and amend these Terms and Conditions in its absolute discretion at any time without notice and without liability. Furthermore, the Promoter reserves the right to terminate the Program in whole or in part in its absolute discretion at any time without notice and without liability. Any and all live GIFTMORE DOLLAR CARD’s will be honoured until the end of their Validity Period (12 months of card being issued).

Permission

28. In order to provide you with a broad range of information in relation to tourism, hospitality and services and to assist in delivering a better service to you, the Promoter may retain the information you have provided in connection with the Program. For details about the Promoter and how we may use your information, and what your rights are under the Privacy laws, please see our Privacy Policy, which is available on www.rendezvoushotels.com.

If you are registering for the Rendezvous GIFTMORE DOLLAR CARD Program online, tick the box in the Rendezvous GIFTMORE DOLLAR CARD online registration form if you do not wish for Rendezvous Hotels & Resorts to send you marketing material for goods and services in the tourism, hospitality or service industries.
